1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the BeeKeeper Pro – Hive Manager mobile application ("App") provided by BeeKeeper Pro ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not download or use the App.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on an Android device you own or control, for your personal, non-commercial beekeeping management purposes. This license does not permit you to:
- Copy, modify, or distribute the App or its source code
- Reverse engineer or attempt to extract the source code
- Rent, lease, or sublicense the App to others
- Use the App to build a competing product or service
3. Accounts & Access
The App requires a Google account for sign-in. You are responsible for maintaining the security of your Google account. A single BeeKeeper Pro account may be shared by a maximum of two (2) users via the Partner feature. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Billing
BeeKeeper Pro offers optional paid subscriptions (Hobbyist, Pro, Commercial) billed monthly through Google Play. By subscribing, you agree to the applicable pricing listed in the App and on Google Play.
- Hobbyist: $1.99 / month
- Pro: $4.99 / month
- Commercial: $14.99 / month
Subscriptions renew automatically each month unless cancelled at least 24 hours before the renewal date. You may cancel at any time through your Google Play account. Refunds are governed by Google Play's refund policy. We do not issue refunds directly.
We reserve the right to change pricing with reasonable advance notice.
5. AI Features
The AI Hive Analysis feature uses Google's Gemini API to analyze photos of honeycomb frames. This feature is provided as a convenience tool only. AI analysis results are not a substitute for professional veterinary, agricultural, or apicultural advice. We make no warranty regarding the accuracy, completeness, or reliability of AI-generated analysis.
You should always verify AI results with your own observation and, where appropriate, consult a qualified expert. We are not liable for decisions made based on AI analysis output.
6. Your Data
You retain ownership of all hive data, inspection records, harvest logs, and other content you create in the App. We do not claim any rights to your data. See our Privacy Policy for full details on data storage and handling.
We are not responsible for data loss resulting from device failure, App uninstallation, or circumstances outside our control. We recommend regularly exporting your data using the App's built-in export features.
7. Prohibited Uses
You agree not to use the App to:
- Violate any applicable laws or regulations
- Upload or transmit illegal, harmful, or offensive content
- Attempt to gain unauthorized access to our systems
- Use automated tools (bots, scrapers) to access the App
- Impersonate another person or entity
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
We do not guarantee that weather data, AI analysis, or any other information provided by the App is accurate or fit for any particular purpose.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEEKEEPER PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF HIVE COLONIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may stop using the App and delete your account at any time. Sections 8, 9, and 11 survive termination.
11. Governing Law
These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Hot Spring County, Arkansas.
